Dear Sir,
1. We convey the present cease and desist letter in the name and on behalf of Ferrari S.p.A,
headquartered at Via Emilia Est 1163 Modena ITALY.
2. As you are certainly aware, Ferrari S.p.A are the owners of the trademark FERRARI since 1967
with registrations in Italy and in many other countries. We quote inter alia - for your ease of reference –
the Italian Registration n. 0000710753 of June 02, 1997 in the classes 3, 6, 14,16,18, 25, 28, 37 and
41; the International Registrations n. 338985 of October 23, 1967 in class 12; n. 439781 of June 13,
1978 in the classes 9, 18, 25 and 28; n. 486294 of 23 March, 1984 in classes 06, 08, 09, 12 14 16;
and The Community Trademark Registrations n. 162099 of November 24, 1998 in classes 12, 37 and
n. 1616457 of October 26, 1998 in classes 3, 6, 9, 14, 16, 18, 24, 25, 28, 41.
3. Please be advised that Ferrari S.p.A. have also secured national registrations in many other
jurisdictions including The Netherlands, Turkey, Japan, China, Poland, Sweden, United States,
Austria, Germany, Spain, Hungary, France, Russia, Vietnam, Romania, Greece, United Kingdom,
Morocco, Egypt and the trademark FERRARI in light of the use is therefore certainly well-known
worldwide.
4. Our clients have recently become aware that you have registered the domain name <>
without any prima facie rights or legitimate interests on said distinctive signs.
5. We note therefore that your registration and use of such domain name confusingly similar to the
Trademark FERRARI constitute a clear infringement of our clients’ trademark rights, due to the
evident risk of confusion with the subject domain name. Please be also advised that Courts in
different jurisdictions and Arbitration Panels, repeatedly stated that registering a third party’s
trademark as a domain name (the so called “domain name grabbing” or “abusive registration of a
domain name”) is to be considered a violation of intellectual property rights.
6. Furthermore, we have ascertained that you are making an active use of the above captioned
domain name publishing on the corresponding web site a parking page with sponsored links
relating also to our client’ products and distinctive signs. Therefore, we note that you are infringing
our clients’ copyrights, trademarks and also intentionally attempting to attract, for commercial gain, Internet users to such web site by creating a likelihood of confusion with our client’s trademark as
to the source, sponsorship, affiliation, or endorsement of your web site.
7. In view of the above, we hereby request that you:
a) immediately cease any use of the said domain name;
b) confirm, in writing to our attention, your availability to immediately transfer the above
captioned domain name, free of any charges, to our clients;
c) undertake not to register and/or use in any other Country the designation FERRARI as a
trademark, as a domain name, as a trade name or, more generally, as a distinctive sign;
d) refrain from simply deleting the domain name since it will be anyway considered by our clients
as a direct assignment from you to a not legitimate third party.
8. Please be advised that our clients are considering to seek compensation of the legal costs born and
damages caused by your registration and use of <>, but they might consider to waive such an
activity or reduce the amount to be claimed, should you promptly reply acknowledging our client's prior
rights.
9. We are confident that you will timely comply with the above requests of Ferrari S.p.A but in absence
of your total acceptance of the above conditions or your detailed reply on the merits of the present
issue, by and not later than 7 days
from receipt of the present letter, our clients will be forced to preserve their intellectual property
rights with any means and in any venue deemed appropriate without any further notice and
reserving all the rights therewith, also with the assistance of our associated law firms in your
Country. We note that this letter is written without prejudice to or waiver of Ferrari S.p.A. rights and
remedies worldwide, all of which are hereby expressly reserved.

Kiro, если тм в этой стране действительно нет, то поздравляю, т.к. у компании большие планы насчет выхода на рынок этой страны в ближайшие пару лет.
Но если я ничего не путаю, то ТМ в этой стране есть уже очень давно:

P.S. А насчет Вашего домена в другой ccTLD они ничего не писали? В этой стране ТМ точно есть, а домен, кстати, нарушает регламент, т.к. ns'ы sedo территориально находятся в т.ч. и в DE. Мелочь, но все же...

Бесплатных сервисов india trademark search не встречал, а те которые есть, дешевыми сложно назвать. Free сервис есть, но только по номеру ищет.

Kiro, не разбираясь в законодательстве этой страны, сложно что-то сказать, если подадут в суд, врядли Вы в полной мере сможете защищать свой домен. Но в этой зоне действует процедура UDRP. Основания для подачи жалобы по UDRP у владельцев TM могут найтись, но думаю, что права на домен можно будет защитить. Дело в том, что сам по себе домен ничего не нарушает, а вот использование домена на парковке, может стать док-вом недобросовестной регистрации. Здесь нужно посмотреть практику по таким вопросам.
В любом случае, бодаться стоит, т.к. в этом случае Вы ничего не теряете.
